Terms and Conditions ("Terms") govern your use of the platform and the products, services, and features we make available to you as part of the platform (collectively, the “Service”). By accessing or using our Service, you agree to be bound by these Terms.

1. Our Service

1.2 The Service enables access to collaborate with selected music and artists in exchange for one-time payment. (“Paid Content”)

2. Use of Service

2.1 Registration:

you may be required to provide information about yourself to register for and to use the Service. You represent and warranty that any such information, including personal data, is and will remain accurate and complete, and that we have no liability for errors and omissions in your personal data. You may be asked to choose a username and password to access or use the Service. You are entirely responsible for maintaining the security of your username and password, and you agree not to disclose or make your username or password accessible to any third party.

2.2 Responsibility of Use:

a. you are solely responsible for any Content you publish on the Service. You must ensure that your Content complies with all applicable laws and regulations, and does not infringe upon the rights of any third party.

2.3 Violation by Third Parties:

We assume no responsibility or liability for violations of this Terms by any other third party that you allow, direct, or enable to access the Service.

c. use, publish, distribute, and display the Content and/or Paid Content for commercial use. Under no circumstances will we be liable for any complaint caused by violation of this restriction or copyright infringement.

d. claim any rights over copyrighted music.

2.5 Eligibility:

You affirm that you are of legal age to enter into this Terms and to use the Service. You affirm that you are otherwise fully able and competent to enter into and abide by the Terms. Your access maybe terminated without warning if it comes to our attention that you are under the legal age to enter into this Terms.

3. Intellectual Property

3.1 Rights We Retain:

a. All materials available on the Service, including but not limited to text, graphics, logos, and images, are the property of us or its licensors and are protected by copyright, trademark, and other intellectual property laws.

3.2 Rights You Grant:

a. By publishing Content on the Service, you grant to us a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to use, reproduce, distribute, create derivative works, and display it, including to promote and operate part or all of the Service.

b. You also grant each other user of the Service a worldwide, non-exclusive, and royalty-free license to access, use, reproduce, distribute, create derivative works, and display your Content.

c. The license in clauses 3.2(a) and 3.2(b) will end when your Content is deleted from our systems.

4. Payment

a. You agree that we may charge your credit card, debit card, or other payment mechanism selected by you, including QR code payment or fund transfer as provided in the order form for all amounts due and owing in connection with your use of the Service.

b. All charges are exclusive of VAT.

c. You can cancel and refund your money in full unless the Paid Content is published. You shall request a refund within 7 days following the date we receive money from you or receive fund from the card company, and the repayment will be processed within 15-30 days.

5. Account Suspension and Termination

การระงับบัญชีชั่วคราวและถาวร

a. If you violate clause 2.4(a), your comments will be deleted and you will get a warning. If the same term is violated, you will not be able to post any comment for 7 days. If you still keep violating the same term, your account will be suspended. However, you have the chance to submit an appeal. In case the same violation occurs within 60 days following the date the suspension is lifted, your account will be terminated.

ก. กรณีที่คุณฝ่าฝืนข้อ 2.4(ก) คอมเม้นท์นั้นจะถูกลบและแจ้งตักเตือน หากคุณกระทำการฝ่าฝืนอีก คุณจะไม่สามารถโพสข้อความเป็นระยะเวลา 7 วัน และถ้าพบว่าคุณยังกระทำการฝ่าฝืนอีก บัญชีของคุณจะถูกระงับการใช้งานชั่วคราว โดยให้ส่งคำขอเข้ามาเพื่อปลดการระงับ กรณีมีกระทำการฝ่าฝืนอีกภายในระยะเวลา 30 วันนับแต่วันที่บัญชีถูกปลดการระงับชั่วคราว บัญชีของคุณจะถูกระงับถาวร

b. if your Content violates clause 2.4(b), your Content will be deleted and you will get a warning. However, your account will be terminated if the same term is violated.

FOR EXAMPLE, WE DON’T MAKE ANY WARRANTIES ABOUT: (A) THE CONTENT PROVIDED THROUGH THE SERVICE; (B) THE SPECIFIC FEATURES OF THE SERVICE, OR ITS ACCURACY, RELIABILITY, AVAILABILITY, OR ABILITY TO MEET YOUR NEEDS; OR (C) THAT ANY CONTENT YOU SUBMIT WILL BE ACCESSIBLE ON THE SERVICE.

ERRORS, MISTAKES, OR INACCURACIES ON THE SERVICE;

PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM YOUR USE OF THE SERVICE;

ANY UNAUTHORIZED ACCESS TO OR USE OF THE SERVICE;

ANY INTERRUPTION OR CESSATION OF THE SERVICE;

ANY VIRUSES OR MALICIOUS CODE TRANSMITTED TO OR THROUGH THE SERVICE BY ANY THIRD PARTY;

ANY CONTENT WHETHER SUBMITTED BY A USER, INCLUDING YOUR USE OF CONTENT; AND/OR

THE REMOVAL OR UNAVAILABILITY OF ANY CONTENT.

6.3 Indemnity:

To the extent permitted by applicable law, you agree to defend, indemnify and hold harmless our officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Service; (b) your violation of this Terms; (c) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (d) any claim that your Content caused damage to a third party. This defense and indemnification obligation will survive this Terms and your use of the Service.

6.4 Modification:

We reserve the right to modify or revise these Terms at any time. Any changes will be effective immediately upon posting the updated Terms on the website. Your continued use of Service after any such changes constitutes your acceptance of the new Terms.

If it turns out that a particular term of this Agreement is not enforceable for any reason, this will not affect any other terms.

These Terms are governed by and construed in accordance with the laws of Thailand. Any dispute arising out of or related to this Terms or your use of Service shall be subject to the exclusive jurisdiction of the courts of Thailand.

ข้อตกลงนี้อยู่ภายใต้บังคับและตีความตามกฎหมายไทย กรณีมีการโต้แย้งสิทธิหรือใช้สิทธิตามข้อตกลงนี้หรือจากการใช้บริการเว็บไซต์ จะต้องดำเนินคดีในศาลไทยที่มีเขตอำนาจ
